Office of the Ombudsman

The purpose of the Mangaung Ombudsman is to contribute towards accelerated service delivery by promoting good governance and advocating for basic human rights to improve the confidence of the residents towards the administration of the City while also ensuring that the city, it’s departments and entities are responsive and held accountable to the communities they serve.

The Office of the Ombudsman is structured to ensure independent, efficient, and impartial complaint handling. The team is led by the Municipal Ombudsman and supported by four core departments and dedicated administrative staff.

Ensure Adherence

Ensure the adherence to the principles of procedural fairness and administrative justice

Investigate Complaints

Investigate complaints of violations of human rights by the administration of the municipality and to seek appropriate redress.

Provide Reporting

Make recommendations to the City Manager in order to enhance the promotion of human rights.

Matters outside our Mandate

The Ombudsman will not accept complaints relating to legislative or executive decisions made by the council, political matters, legal or arbitrary proceedings to which the council is likely to be a party to, any acts of irregular conduct of a councillor and/or labour law matters.

Impartiality

An ombudsman's impartiality is central to their function, which involves investigating complaints in a fair and unbiased manner without favoring any party. Their role is to be a neutral and independent mediator, assessing disputes objectively and seeking fair and equitable solutions for all involved, according to principles of natural justice.

Functions & Powers

The Ombudsman may, at his or her own instance, and must, on receipt of a complaint in terms of section 8 of the Ombudsman By-Law 2023, investigate any alleged act or omission or any attempts by an employee serving in the municipality or municipal entity which constitutes:
any contravention of item 2, 4(1)(a) or (b); 5, 6(1), 7, 8, 9 or 12 of the Code of Conduct for Municipal Staff Members contained in Schedule 2 to the Municipal Systems Act;
any failure to comply with the provisions of section 5(1)(b), (c), (f) or (g) of the Municipal Systems Act;
any maladministration in the affairs of the municipality to the prejudice of a member of public;
any abuse or unjustifiable excercise of power, whether such power is held under a delegation or in terms of any law;
any unfair, capricious or discourteous conduct;
any improper conduct in the affairs of the municipality which directly or indirectly prejudices of the public;
any other act or omission by an employee performing a public function which results in the unlawful or improper prejuice to a member of the public.
